1. General Provisions
These Terms of Service ("Terms") govern your access to and use of the TesvikAra platform ("Platform"), operated by Penfai LLC ("Company", "we", "us") at tesvikara.com. By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Platform immediately.
2. Service Description
TesvikAra is an AI-powered incentive discovery and application management platform. The Platform provides the following services:
- AI-driven matching of government incentive programs to your business profile.
- Detailed information and comparison of incentive programs across multiple agencies.
- AI chatbot for incentive advisory and frequently asked questions.
- Application assistant for form preparation and document tracking.
- Performance dashboard with analytics and reporting.
The Platform does not guarantee the approval of any incentive application. Matching results are AI-generated recommendations, and final decisions rest with the relevant government authorities. The information provided on the Platform is for informational purposes and does not constitute professional legal, financial, or tax advice.
3. User Accounts
To use the Platform, you must create an account with a valid email address. You are responsible for maintaining the accuracy and security of your account credentials. All activities performed under your account are your responsibility. You must not share your password with third parties. If you detect any unauthorized access or suspicious activity, you must notify us immediately at support@penfai.com.
4. Subscriptions and Payment
The Platform operates on a subscription model with monthly, annual, and one-time payment options. All plans include a 14-day free trial. Billing begins at the end of the trial period based on your selected plan. Monthly subscriptions renew automatically each billing cycle; cancellations take effect at the end of the current billing period.
Prices are denominated in Turkish Lira and include applicable taxes. The Company reserves the right to modify pricing with 30 days' prior notice. Payment transactions are processed through a secure payment infrastructure; we do not store credit card information on our servers.
5. Intellectual Property
All content, software, designs, logos, text, graphics, and other materials on the Platform are the intellectual property of Penfai LLC and are protected under the laws of the Republic of Turkey and international intellectual property treaties. Users are granted a limited, non-exclusive, non-transferable license to use the Platform for personal and commercial purposes in accordance with these Terms. Copying, reproducing, distributing, or reverse-engineering any part of the Platform is strictly prohibited.
6. User Obligations
By using the Platform, you agree to:
- Provide accurate and up-to-date information.
- Use the Platform only for lawful purposes.
- Refrain from using automated bots, scrapers, or similar tools to access the Platform.
- Not engage in any conduct that infringes upon the rights of other users.
- Avoid any actions that could compromise the security or integrity of the Platform.
7. Limitation of Liability
The Platform is provided on an "as is" and "as available" basis. The Company does not warrant that the services will be uninterrupted, error-free, or entirely secure. AI-generated incentive matches and recommendations are for informational purposes only and do not replace professional advisory services. The Company shall not be held liable for indirect, incidental, or consequential damages arising from incentive application outcomes, data loss, or Platform usage. The Company's total liability shall not exceed the subscription fees paid by the user during the preceding twelve-month period.
8. Account Suspension and Termination
The Company reserves the right to suspend or terminate user accounts that violate these Terms, with prior notice where practicable, or immediately in cases of serious breach. In the event of termination, no refund shall be issued for the remaining subscription period. Users may close their accounts at any time; data will be handled in accordance with our Privacy Policy.
9. Modifications
The Company reserves the right to update these Terms at any time. Material changes will be communicated via email or in-Platform notification. Your continued use of the Platform after such changes constitutes acceptance of the updated Terms.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Turkey. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts and enforcement offices of Istanbul, Turkey. The parties agree to attempt mediation before initiating formal legal proceedings.
